Petición para solicitar al Gobierno la salida del Tratado de la Carta de la Energía porque impide la transición hacia energías limpias
Los combustibles fósiles representan un 72% del suministro energético en Europa y deben ser abandonados de forma urgente para evitar una catástrofe a nivel climático. Impulsar una transición rápida hacia un sistema energético libre de combustibles fósiles es vital.
El Tratado de la Carta de la Energía (TCE) supone un obstáculo fundamental para esta transición. Protege las inversiones relacionadas con el suministro de energía, incluyendo las minas de carbón, la extracción de petróleo y gas, los gaseoductos, las refinerías y las centrales térmicas. El Tratado concede a las compañías energéticas la posibilidad de demandar a los Estados por prácticamente cualquier medida que vaya en conta de las expectativas de beneficios de los inversores. Este tipo de demandas no se resuelven en los tribunales nacionales, sino en tribunales de arbitraje privados que no son transparentes. Los Estados ya se han visto obligados a pagar miles de millones de euros (del dinero de todas las personas contribuyentes). Los inversores pueden incluso reclamar y recibir compensaciones por las expectativas de ganancias en el futuro.
Las compañías energéticas están utilizando el TCE para ralentizar el proceso de abandono de os combustibles fósiles. Por ejemplo, la petrolera británica Rockhopper ha demandado a Italia por prohibir la extracción de petróleo en sus costas, reclamando siete veces la cantidad que la compañía invirtió inicialmente. La multinacional energética británica Ascent Resources ha demandado a Eslovenia por exigir a la compañía que lleve a cabo un estudio de impacto ambiental antes de iniciar exploraciones de gas mediante fracking. En los Países Bajos, el operador de una central térmica de carbón ha iniciado un procedimiento judicial contra el Gobierno holandés amparándose en el TCE. Según la información disponible, reclama una indemnización de mil millones de euros.
La simple amenaza de demanda bajo el TCE puede ser suficiente para disuadir a los gobiernos de legislar a favor del interés general. Por ello, las personas firmantes de esta carta consideramos que el Tratado de la carta de la Energía es uno de los grandes obstáculos para la implementación del Acuerdo de París y el Pacto Verde Europeo.
Hacemos un llamamiento a la Unión Europea y a los 53 países signatarios del TCE a llevar a cabo las siguientes acciones de forma inmediata:
− Retirarse del Tratado de la Carta de la Energía. El TCE es un tratado obsoleto. El proceso actual de reforma del Tratado (conocido como "proceso de modernización") no debe utilizarse como excusa para aplazar la salida del TCE, ya que no servirá para que el Tratado sea compatible con el Acuerdo de París. El fin de la protección a las inversiones extranjeras en combustibles fósiles ni siquiera está en la agenda de negociación y sería, en cualquier caso, inaceptable para muchos países signatarios del TCE que deben aprobar las reformas por unanimidad.
− Trabajar de forma conjunta en un acuerdo para acabar con la "cláusula de supervivencia". Esta cláusula permite a los inversores extranjeros demandar a los Gobiernos hasta 20 años después de que hayan abandonado el TCE. Para solventar este problema, hacemos un llamamiento a los países para que se retiren del Tratado de forma simultánea y que adopten un acuerdo para excluir las demandas de los inversores efectuadas dentro del grupo de países que lo abandonen.
− Detener la expansión del TCE en otros países. Actualmente decenas de países de África, Asia y Latinoamérica de ingresos medios y bajos están siendo alentados a unirse al TCE. La Unión Europea está financiando este proceso de expansión con fondos públicos. Esta expansión debe detenerse.
La emergencia climática no admite retrasos. Si los Gobiernos quieren liderar la lucha contra el cambio climático, deben alejarse de tratados de comercio e inversión que los atan de pies y manos a la protección de los combustibles fósiles, a costa del dinero de los y las contribuyentes. La retirada del Tratado de la Carta de la Energía es un primer paso fundamental.

El Tratado de la Carta de la Energía (TCE) protege las inversiones extranjeras en combustibles fósiles y obstaculiza la transición a energías limpias.
Dos días antes de la reunión del Consejo Europeo el 10 y 11 de diciembre de 2020, esta carta abierta firmada por más de 200 personas de la comunidad científica y personas vinculadas a la divulgación de la crisis climática, junto con otras declaraciones del movimiento juvenil, los europarlamentarios y europarlamentarias y la comunidad empresarial, establece medidas concretas que deben adoptarse para alcanzar los objetivos climáticos planteados por Europa y retirarse del TCE.

Si el Tratado no se reforma de manera sustancial, en 2050 la protección de las inversiones extranjeras en combustibles fósiles dará lugar a:
- Más emisiones de gases de efecto invernadero (GEI) al menos 216 gigatoneladas de emisiones GEI serán protegidas bajo este Tratado, una cifra equivalente a más de un tercio del presupuesto global de carbono restante para el período 2018-2050.
- Costes elevados para los Estados: los activos irrecuperables de la industria fósil protegidos por el TCE podrían alcanzar 2,15 billones de euros. La implementación de medidas encaminadas a lograr el objetivo de neutralidad climática podría dar lugar a 1,3 billones de euros de costes por demandas ISDS. Como referencia, la UE estima que las inversiones necesarias para financiar el Pacto Verde Europeo en los próximos 10 años ascienden a 1 billón de euros.
- Graves impactos en los países del Sur Global debido a la expansión del TCE: países de África, Asia y América Latina con grandes reservas fósiles se verán atrapados en un sistema energético obsoleto que resultará ser una carga económica además de tener impactos en la salud humana en las décadas venideras.
Esta situación es insostenible. Por ello, personas de la comunidad científica y personas vinculadas a la divulgación de la crisis climática instan a la UE y a sus Estados miembro a que consideren abandonar el TCE como una prioridad. Creemos que una evolución rápida del debate público sobre este tema puede acelerar esta decisión.
